Liability Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

In consideration of being permitted to use the facilities, equipment, and services of Denver Racing Social, LLC d/b/a DRS Clubhouse ("DRS"), located at 7542 S. Potomac St. Unit B-01, Centennial, CO 80112, I agree to the following:

1. ASSUMPTION OF RISK

I understand that participating in simulator racing activities involves risks of injury, including but not limited to physical injury, property damage, and emotional distress. I voluntarily assume all risks associated with my use of the DRS Clubhouse facilities and equipment, whether or not such risks are described herein.

2. RELEASE OF LIABILITY

I hereby release, waive, discharge, and covenant not to sue DRS, its owners, officers, employees, agents, volunteers, and affiliates ("Released Parties") from any and all claims, demands, losses, liabilities, or causes of action of any nature arising out of or related to my participation in any activities at DRS Clubhouse, including claims arising from the negligence of any Released Party.

3. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in activities at DRS Clubhouse, whether caused by the negligence of the Released Parties or otherwise.

4. EQUIPMENT AND FACILITY USE

I agree to use all equipment and facilities in a responsible manner and in accordance with any rules or instructions provided by DRS staff. I agree to be financially responsible for any damage I cause to DRS equipment or property through reckless or intentional misuse.

5. MEDICAL AUTHORIZATION

In the event of an emergency, I authorize DRS staff to seek emergency medical treatment on my behalf and agree to be responsible for any costs incurred.

6. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising from this Agreement shall be resolved in the courts of Arapahoe County, Colorado.

I have read this agreement, understand its terms, and agree to be bound by them. I am 18 years of age or older, or I have obtained parental/guardian consent.
